Voter roll purge won't happen in Minnesota

This is a victory for federalism and the plain reading of the law, notwithstanding howls that this is somehow about purging minority voters. OH defended its practice by citing a provision of the 1993 National Voter Registration Act that states can remove potential voters from their lists and cancel registrations if they move. There have been no reported cases of OH voters who've moved elsewhere and attempted to vote twice. He was joined by his four conservative colleagues in an opinion that drew praise from Republican officials and conservative scholars.

The SCOTUS ruling wasn't limited to the Buckeye State, as a handful of other states follow the voter purge act as well.

In the past, the Justice Department has opposed Ohio's process as inconsistent with federal law.

Taken as a whole, this welter of provisions could plausibly be read in the way Justice Samuel Alito does on behalf of the Courts' Republicans - as an instruction manual to carry out the sort of voter purge that OH used in this case.

"Over the last five years, key Supreme Court decisions have undermined the franchise of millions of Americans", Grimes said.

President Donald Trump hailed the ruling from Singapore on Tuesday, tweeting: "Just won big Supreme Court decision on Voting!"

Breyer pointed out that about 1 million OH registered voters - or 13 percent of the state's voting population - did not send back their cards, and "the streets of Ohio's cities are not filled with moving vans".

The court's dissenters said OH violates a prohibition in federal law against removing voters simply because they are exercising their right not to vote. That law bars states from removing anyone "by reason of the person's failure to vote".

Kander, who is eyeing a 2020 presidential bid, said the Supreme Court's decision highlights the need for groups like his to spotlight voter purges, which he said are highly likely to sweep up eligible voters whose registrations ought not be canceled.

Breyer said the federal law's protections of infrequent voters "are most naturally read to prohibit a State from considering a registrant's failure to vote as part of any process" that results in a purge.

"The notice in question here warns recipients that unless they take the simple and easy step of mailing back the pre-addressed, postage prepaid card - or take the equally easy step of updating their information online - their names may be removed from the voting rolls if they do not vote during the next four years", Justice Alito wrote.

He continued, "This decision is validation of Ohio's efforts to clean up the voter rolls and now with the blessing nation's highest court, it can serve as a model for other states to use". The 1993 voter registration act was enacted "against the backdrop of substantial efforts by states to disenfranchise low-income and minority voters", she wrote. If voters fail to return the notices and do not vote in another election for four years, OH cancels their registration. OH is the only one that starts the removal process after failing to vote in only one election, the center said.

OH has sent more than 3 million notices of address confirmation since 2011, when Husted became Secretary of State.

This case, like many others, should never even have been in court, allowing wayward judges and the ACLU to lock up a commonsense law for several years and election cycles.

Republican President Donald Trump's administration backed OH, reversing the stance taken by Democratic former President Barack Obama's administration against the policy, and welcomed the ruling.
