The battle over Kavanaugh's documents has been a dominant story line in the fight to replace the retired Justice Anthony Kennedy. Add Supreme Court as an interest to stay up to date on the latest Supreme Court news, video, and analysis from ABC News.

While Kavanaugh has upheld precedent during his time as a judge, it is uncertain if that will change if he is confirmed as a Supreme Court justice.

William Burck, an attorney for former President George W. Bush tasked with reviewing the documents, wrote a letter to the Senate Judiciary Committee saying he and his team had provided "every reviewable document", excluding exact duplicates of electronic records, personal documents, presidential records outside Kavanaugh's service and presidential records protected by constitutional privilege.

In all, 267,000 pages of Kavanaugh documents from his years as a Bush aide are being made public.

Senate Minority Leader Charles Schumer, D-New York, called the disclosure that the Trump White House is withholding more than 100,000 pages of Kavanaugh's records a "Friday night document massacre" and said it has all the makings of a coverup.

It's a time Democrats say is key in giving context to his time as a partisan Republican.

In his letter, Burck defined the withheld documents as those that "reflect deliberations and candid advice concerning the selection of judicial candidates" as well as advice submitted directly to Bush, substantive communications between White House staff about discussions with the President and "substantive deliberative discussions relating to or about executive orders or legislation considered by the Executive Office".

Sen. Dick Durbin of IL, the second-ranking Democrat in the Senate and also a member of the Judiciary Committee, said on "FOX News Sunday" that they'd be lucky to see six percent of all the documents out there.

"Republicans in the Senate and the president of the United States are colluding to keep Judge Kavanaugh's records secret and trying to hide their actions from the American people by doing it on the Friday night of a holiday weekend", Schumer said.

Kavanaugh's confirmation is complicated by the sheer number of emails that exist during his years in the White House.

"It's not normal", Senator Amy Klobuchar of Minnesota told NBC's Meet the Press, "because we are not able to see 100,000 documents because the administration has said we can't see them, exerting their executive power". "So I can't even tell you about them right now on this show", Klobuchar said.

However, Senator Lindsey Graham claimed that Kavanaugh may change the status quo of Roe v. Wade if given the opportunity.
