Lindsey Graham: No 'Holy Hell to Pay' for Sessions Firing

Matthew Whitaker is replacing his former boss Jeff Sessions

Sessions had been an avid supporter from the beginning of the Trump campaign, but ran afoul of the President when he recused himself from the probe on Russia's interference after it was revealed that Sessions had had two meetings with the former ambassador from Russia, Sergey Kislyak.

"The firing of Sessions is widely viewed as a possible attempt to obstruct the ongoing special counsel investigation being conducted by the U.S. Department of Justice and headed by former FBI director Robert Mueller", said the organizers in a release.

The challenge has been brought by Andrew Miller, an ex-Roger Stone aide who argues that Mueller's appointment was unconstitutional because it was made by Deputy Attorney General Rod Rosenstein - who had oversight over the federal Russian Federation investigation because Sessions was recused - rather than by the attorney general.

Meanwhlie, Democrats on the House Judiciary Committee say Deputy Attorney General Rod Rosenstein should continue oversight of the Mueller investigation.

"No matter who I put in, they go after him", he said.

Special counsel Robert Mueller and his team of prosecutors are in the process of writing a final report on the almost 18-month long investigation into Russian meddling during the 2016 election, sources tell ABC News.

George Conway III, a prominent lawyer, penned an op-ed in the New York Times along with former solicitor general Neal Katyal, arguing that Trump's power play at the Justice Department is 'unconstitutional'. He also said there was no evidence Russian Federation interfered in the election at all.

"There is a lot to fight against with this administration; both the president himself, but also the people he has appointed", she said.

Sessions was ousted as attorney general Wednesday, the day after the USA midterm elections.

In this April 24, 2014, file photo, then-Iowa Republican senatorial candidate and former United States attorney Matt Whitaker watches before a live televised debate in Johnston, Iowa.

US Attorney General Jeff Sessions has endured more than a year of criticism from Donald Trump over the Mueller inquiry. The president claimed on Twitter that the investigation into obstruction of justice was "an illegal scam" and declared in a July 29 Twitter post and elsewhere, "There is no collusion!"

Many in the crowd wore shirts supporting Democrat gubernatorial candidate Andrew Gillum, who trailed Republican Ron DeSantis in the vote totals but closed the gap enough to trigger an automatic recount.

While speaking to reporters on Wednesday, Conway explained President Trump is not planning to use the resignation as a way to shut down the Mueller probe.

But it's unclear how this requirement operates in regard to the attorney general, who has no identifiable supervisor other than the president.

The president said he is also looking at "other people" to nominate for the permanent position of Attorney General, and will make a decision in the next few weeks.

"The (Democrats') first step would be to protect the investigation, they would do that by making sure all documents were secured by ensuring Mueller's investigative team was not broken up", he said, adding: "On Capitol Hill, the Democrats are quite likely to call for a floor vote immediately to countermand and reverse the firing". And we asked for any documents providing clarification as to how certain key conflict of interest regulations apply in practice to the attorney general. However, Trump derided his argument, calling him "Mr Kellyanne Conway" and insisted that Conway, who has been a critic of Trump, was only interested in publicity.

As attorney general, and earlier as White House counsel, he faced criticism for drafting controversial rules for military war tribunals, seeking to limit the legal rights of detainees at the USA prison in Guantanamo Bay, Cuba.
