Ex-Trump aide Flynn does not deserve jail, lawyers say

Flynn's sentencing has been postponed four times over the past year.

Lawyers for Trump's former national security adviser Michael Flynn asked a judge Tuesday to spare him prison time, saying he had devoted his career to his country and taken responsibility for an "uncharacteristic error in judgment".

Since Mueller's obvious conflicts of interest-including his ties to former FBI Director James Comey, his service under the Obama administration, and a team of biased prosecutors-"other good cause" could be the failure to produce court-ordered documents related to the Flynn case or the special counsel's office scrubbing the iPhones used by Strzok and Page during their brief time on the team, or both.

"Those misimpressions do not change the fact - as the defendant has admitted in sworn testimony to this district court - that he was indeed lying and knowingly made false statements to FBI agents in a national security investigation", the special counsel's filing said. "The Court should reject the defendant's attempt to minimize the seriousness of those false statements to the FBI", Mueller argued."The circumstances of the defendant's interview also show that his decision to make false statements was voluntary and intentional". Yates met with then-White House Counsel Don McGahn the following day to discuss the matter again, she later testified in front of Congress, and on January 30, she called McGahn to invite him to the Justice Department to review the underlying evidence showing Flynn had made false statements.

Flynn is set to be sentenced on Tuesday. "They convinced him he did lie, and he made some kind of a deal", Trump said in the television interview.

Two weeks after the meeting, Flynn was sacked for lying to the Federal Bureau of Investigation and lying to Vice President Mike Pence.

Strzok described Flynn as "relaxed and jocular" during the interview.

Attorneys for Paul Manafort say they're still deciding whether to dispute allegations that their client lied to investigators and breached his plea agreement with special counsel Robert Mueller. After the FBI charged Flynn, he agreed to cooperate with Mueller's investigation.

Flynn is the only Trump administration official to plead guilty to a crime connected to Mueller's sprawling probe into Russian attempts to influence the 2016 US election.

During the campaign, Flynn was a close adviser to Trump. Then-FBI Deputy Director Andrew McCabe, who had arranged the interview but wasn't present for it, was sacked for what the Justice Department called a lack of candor involving a media leak.

In total, Flynn met 19 times with the special counsel's office and others, for nearly 63 hours, they said.

JOHNSON: The lawyers don't go so far as to mount some kind of entrapment case, but they are offering some suggestions if the judge who's ultimately going to sentence Mike Flynn next week wants to grab at those. American intelligence agencies and Mueller have said Russian Federation was the source of hacked material released by WikiLeaks during the campaign that was damaging to Hillary Clinton's presidential effort.

But after pleading guilty, Flynn began co-operative extensively with the Justice Department, sitting for 19 interviews with prosecutors in multiple investigations. Around the same time, President Donald Trump's former attorney Michael Cohen pleaded guilty to eight federal charges.

Former federal prosecutor Joe diGenova blasted the federal government for what he called "one of the most disgraceful events in American criminal justice".
