Qualcomm wants iPhone Xs, Xs Max, XR banned in China too

Reuters reports that, in a bid to ensure its iPhones aren't yanked from shelves, Apple has confirmed that it will push out a software update on at the start of next week "to address any possible concern about our compliance with the order".

Apple has pledged to update its smartphone software in China to avoid a court-imposed sales ban following a legal spat with Qualcomm over alleged patent infringements. Even if Apple does force all iPhone users in China to upgrade to the current version of iOS, Qualcomm is still seeking a settlement.

Apple warned that the ban would hurt Chinese manufacturers like Foxconn and noted that it had created 5 million jobs across the countrys supply chain.

"We plan to use the same patents to file suit against the three new iPhone models", Jiang Hongyi, a lawyer at Lexfield Law Offices who is representing Qualcomm in its patent suits, told the FT.

However, it appears a software update won't appease Qualcomm. Apple's response underscores the importance of the Chinese market, as well as Qualcomm's crucial role as a technology provider to the likes of Huawei Technologies Co. and Xiaomi Corp. Apple notes that the ban will cost it millions of dollars a day and negatively affect Chinese consumers as well as the government as the latter could lose hundreds of thousands of tax. According to The Financial Times (via Engadget), Qualcomm is now pushing for the sales ban to also include the Apple iPhone XS, iPhone XS Max, and iPhone XR.

Qualcomm and Apple's legal battle dates back to early 2017 when Apple hit the chipmaker with a $1 billion lawsuit over what the company alleges were unfair patent licensing practices.

We can only assume that next week we will learn whether the Chinese courts will grant Apple some leniency in this case.
