House vote to stop Trump's border wall plan likely to fail

The Democratic-led House of Representatives tried to override President Donald Trump's veto on a resolution to block his border national emergency declaration, but it failed, and Republicans are taking notice.

The vote was 248-181, with 14 Republicans voting with Democrats to support the override. The vote kills Democrats' legislative effort to rein in Trump's plan to fund a wall on the border with Mexico, and it demonstrates the president's enduring influence over GOP lawmakers.

Trump had declared the border emergency under a law that lets him shift budget funds to address dire situations. "We are establishing the intent of Congress", she said at an event in NY last week during the congressional recess.

Democrats argued the Republican president had overstepped his authority by going around Congress, because the legislature has the power to control spending under the US Constitution.

Slamming the "lawless" emergency declaration by Trump, House Speaker Nancy Pelosi and Democrat Senator from Texas Joaquin Castro outlined the future course of action the party would take after the vote, The Hill newspaper reported.

In February, California and 15 other states filed lawsuits against the declaration, saying it is unconstitutional.

That political victory for Trump may make it more challenging for Republicans to defy the president on a range of things, including his signature issue, the border wall.

The veto override was never expected to be successful, but Democrats still wanted to take the vote to continue hammering home their point that it is Congress, not the president, controlling the power of the purse. Both the House and Senate did vote to stop the emergency, but the president's veto trumped them.

Tuesday's vote bolsters Trump's drive to build a wall along the boundary with Mexico, a hallmark of his 2016 presidential campaign and a priority of his presidency.

"Even though the two issues clearly aren't related, it increases the president's strength and popularity and puts him in a stronger position", Republican Representative Tom Cole said before the House vote.

That law also gave Congress the power to thwart him, if it could muster the votes. Trump's insistence on wall money prompted this winter's record 35-day partial government shutdown, which ended when he surrendered in January without getting any funds.

The House approved the resolution blocking Trump's emergency by 245-182 in February. Earlier this month, Senate Minority Leader Chuck Schumer said that the President's emergency declaration allows for a resolution of disapproval to be brought up every six months, and that Democrats intend to bring it up again at that time. On Tuesday, Trump opponents will need to reach 288 votes to prevail.
