Yogi Adityanath, Mayawati Banned From Campaigning by Election Commission For Violating MCC

India ‘undermined’ Pakistan’s nuclear threat, claims Modi

A report in the Hindustan Times, quoted the EC panel, "The Commission, under Article 324 of the Constitution of India and all other powers enabling in this behalf, bars him from holding any public meetings, public processions, public rallies, road shows and interviews, public utterances (electronic, print, social media) etc in connection with ongoing elections for 72 hours from 6 am on 16 April 2019", the panel said. Yogi was also served a notice by the EC and was asked to explain his stand on the issue in 24 hours.

The Supreme Court too took note of the alleged hate speeches made by the two leaders and asked the poll body about the action initiated in the whole matter.

Mayawati had on Saturday said her party wanted both Ali and Bajrang Bali - particularly Bajrang Bali - as the deity was "linked with my own Dalit caste".

Adityanath was previously warned by the EC as he was found violating the MCC, by saying ' Modiji ki sena, ' while raking up the Balakot air strike during a Ghaziabad rally.

The SC, in its order, referred to the stringent provisions of the Representation of the People Act under Sections 123 (3) and 125, which if used, could see a candidate getting disqualified if he or his election agent appealed to voters in the name of religion or made any hate speech.

The commission on Monday also banned Azam Khan, a leader from the Samajwadi Party (SP), an ally of the BSP, and minister Maneka Gandhi from campaigning for violating the code of conduct.

A bench headed by Chief Justice Ranjan Gogoi summoned a representative of the poll panel on Tuesday, while agreeing to examine its contention that it has limited legal power to deal with hate speeches of politicians during electioneering.

EC's counsel Amit Sharma informed the court that notices were issued to both Mayawati and Adityanath on April 11 but they had not filed their replies.

But the Congress has taken issue with such assertions, in particular, pointing to leaked government data that showed unemployment rose to its highest level in at least 45 years in 2017/18.

The functionary said the commission examined the two issues on April 14 and April 15, and came up with the final decision on Monday as it felt a clear message should go out to the politicians.

CM Adityanath had compared the Lok Sabha election to a contest between "Ali", a revered figure in Islam, and Bajrang Bali, the Hindu god Hanuman.
